SERVICE COMMITMENT

CARLY SINDEN PHOTOGRAPHY is dedicated to delivering high-quality photography services, utilising professional expertise, creativity, and technical knowledge to produce stunning images. We commit to completing all post-production work and providing the final gallery to clients as outlined in their chosen package within 30 days of the session date for maternity, newborn, and family portrait sessions. Packages that include albums or printed products may require additional processing time. All final images are delivered in high-resolution JPEG format.

For studio and outdoor sessions, galleries are available for viewing within 3 weeks from your session date. Payments are due at the time of gallery selection, and proof of payment is required. RAW files are not included in any package. Our service includes curating the best images, offering them for selection, and enhancing them for optimal quality in both print and digital formats.

Cancellations and Rescheduling:
All session fees are non-refundable. Once a booking is confirmed, the photographer commits the date exclusively to the client. Cancellations without valid reasons (determined at the photographer’s discretion) will forfeit 100% of the session fee. Clients may be responsible for reimbursing any expenses incurred by the photographer between the time of booking and cancellation. If the client fails to notify us within seven days regarding a reschedule or leaves a session already in progress, a full session fee is required to book a new date.

If a session is rescheduled due to illness, the originally quoted price will be honoured for three months. After this period, any price increases will apply. If a session is canceled with more than seven days' notice but is not immediately rebooked, a credit for the funds paid will be issued, but any future pricing adjustments will take effect.

Late Arrivals:
Clients who arrive late will have their session time reduced accordingly. It is the client’s responsibility to ensure all participants and necessary items are present and ready at the scheduled start time.

Weather-Related Rescheduling:
For outdoor sessions, if weather conditions (such as rain, storms, or extreme overcast and wind) could negatively impact the quality of the images, we reserve the right to reschedule to the next available date. Both the client and photographer will work together to find a suitable time. We are not liable for any additional costs incurred by the client, such as expenses for props, flowers, hair and makeup, travel, or potential loss of income.

Unpaid Orders and Debt Collection:
Clients are responsible for making full payment before any print orders are processed. In the event of unpaid balances, the client will be responsible for any debt collection costs incurred, including agency fees, legal costs, and administrative expenses.

Print Orders and Delivery:
All print orders require full payment before processing. Clients must inspect their orders upon receipt and notify us in writing within 24 hours if items are damaged or incorrect. Without notification, products will be considered accepted. We take all reasonable precautions to protect client property, but we are not liable for any loss, damage, or destruction outside of negligence. Clients are responsible for any shipping costs related to the delivery or return of printed products. Orders are final once confirmed and subject to additional charges for modifications.
Photographic Style and Artistic Discretion:
While we make every effort to accommodate client requests, the final artistic direction—including poses, locations, and post-processing—is at the discretion of the photographer. Our work follows a consistent brand and style, and all images will be edited accordingly.

Copyright and Image Usage:
All images remain the copyright of CARLY SINDEN PHOTOGRAPHY and may not be used for commercial purposes without prior written consent and applicable fees. Clients are granted a personal-use license upon full payment. No alterations, such as filters or edits, may be made to the images without permission.

Liability:
In the rare case of image loss due to technical malfunctions or unforeseen circumstances, liability is limited to the refund of the session fee. We are not responsible for any indirect or consequential losses.

Image Delivery and Storage:
Final images will be delivered via an online gallery, with a link sent via email. Clients are responsible for downloading and backing up their images within the timeframe specified. We do not guarantee image storage beyond delivery, and retrieval requests may incur additional fees.

Indemnification:
The client agrees to release and hold the photographer harmless from any claims, damages, or expenses arising from the photography session. This includes any third-party claims regarding the use of the images.
Website Use Terms:
Clients may access and view content on our website for personal use but may not copy, reproduce, or distribute any images without written permission. While we take reasonable care to provide accurate information, we are not liable for errors or omissions.

Promotions and Discounts:
Promotional discounts do not apply to previously booked sessions. Offers cannot be combined and are not redeemable for cash or product credits.

Behaviour and Conduct:
Clients who behave in a disorderly manner or disrespect the photographer and equipment may have their session terminated immediately without a refund.

Quotations and Pricing:
Quotes are valid for 30 days and may be subject to change thereafter.

Refund Policy:
Session fees, vouchers, and payments toward orders are non-refundable. Unused voucher credit will not be refunded to either the purchaser or recipient. Orders are final upon payment. Reversing or canceling electronic payments will result in debt collection, with the client responsible for associated costs.

Booking and Payments:
A session is confirmed only upon payment of the booking fee and signing of this agreement. The remaining balance must be paid at least 24 hours before the session. Upgrade payments are due immediately upon gallery selection.

Reimbursement of Expenses:
The client agrees to reimburse the photographer for any out-of-pocket expenses incurred during the fulfilment of services, including but not limited to travel, meals, and parking, with proof of expense provided.

Client Cooperation:
Clients are responsible for providing necessary cooperation to ensure the best possible outcome for their images. This includes following guidance on wardrobe, location, posing and preparing for your photoshoot session.
These terms and conditions are subject to change at the discretion of CARLY SINDEN PHOTOGRAPHY. By booking a session, you agree to these terms in full.
